Employment Practices Liability Insurance (EPLI) protects your business against wrongful termination, discrimination or sexual harassment suits by current, prospective or former employees. This coverage applies to officers and employees, and can extend to third party liabilities.
What Does It Cover?
Retaliation - Firing an employee for notifying authorities of unlawful activity at your business.
Defamation - Calling an employee a thief in front of others without proof or evidence.
Negligent HR Decisions - Hiring an unqualified job applicant due to nepotism or favoritism
Negligent Evaluation - Making up a false incident report about an employee during a review
Negligent Supervision - If you leave an employee unsupervised and they start a fire.
What Doesn’t Get Covered?
Penalties & Fines - Penalties, punitive damages (this can vary by state), civil fines, unpaid wages and criminal fines.
Claims of Bodily Injury - In addition to unpaid wages, rest and meal times, bullying, liabilities for acts of intentional or dishonest wrongdoing.
Property Damage - Incidents of property damage would be covered under you Commercial General Liability or Commercial Property policy, depending on the owner of the damaged property
Actions Occurring Outside the U.S. - EPLI coverage only applies to actions or incidents occurring in the United States.
